• Testing limits: Fee covers the mandatory annual inspection and diagnostic test
of a specific backflow preventer.
• Exclusions: Basic testing fees do not include parts, labor for repairs, re-testing
after a failure, or municipal filing fees unless specified.
• Certification status: Statements clarifying that the company employs certified
cross-connection control technicians.
2. Property Access & Customer Responsibilities
Because backflow assemblies are often located outdoors or in utility rooms, explicit
permission is required.
• Right of entry: The customer grants technicians permission to enter the
property's exterior grounds to access the device.
• Clearance: Assemblies must be completely visible, free of overgrowth, and
cleared of dirt, debris, or locks.
• Unresolved barriers: If entry is blocked by a locked gate, aggressive animal, or
buried device, the customer may face a trip charge.
• Absence clause: The customer agrees that testing can proceed without them
being physically present if the device is outside.
3. Water Service Disruption & Liability Waiver
Testing completely stops water flow, which presents unique risks to the property owner.
• Shutdown acknowledgment: The customer acknowledges that the main water
supply or irrigation line will be turned off temporarily during the test.
• Damage waivers: The company is explicitly not liable for downstream damages
caused by sudden water depressurization or restoration (e.g., dislodged
sediment, water heater issues, or compromised old plumbing lines).
• Commercial critical systems: Commercial customers must handle internal
bypasses for fire lines, medical facilities, or critical machinery before the
technician arrives.
4. Test Failures, Repairs, & Replacements
Many assemblies fail testing due to worn rubber parts or internal springs.
• No performance guarantee: Passing a test only certifies the device was
functioning at that exact moment; it does not guarantee future performance.
• Authorization of repairs: If an assembly fails, repairs or replacements are
treated as a separate scope of work requiring new cost approvals.• Emergency authority: Clauses indicating if the technician has pre-authorization
to perform minor repairs under a specific dollar threshold to ensure a passing
score.
5. Municipal Reporting & Data Sharing
Backflow testing is heavily regulated by local water authorities.
• Submission obligation: The company agrees to submit passing or failing test
reports to the relevant city, county, or water district database within required legal
windows.
• Data release authorization: The customer explicitly allows the business to
transmit personal information, addresses, and assembly serial numbers to local
municipal portals.
6. Billing, Cancellation, & Past Due Fees
Standard financial protections adapted for service routes.
• Routing flexibility: Booking dates are considered "preferred windows." Actual
arrival times depend on daily geographic route efficiency.
• Filing fee pass-through: Explicit statements showing whether municipal
platform submission fees (e.g., third-party trackers) are integrated or added to
the bill.
• Late fees & liens: All invoices are due upon completion of work. Capitol
Backflow, LLC retains the rights to pause future data submission to the city until
payment clears. Any payments not paid by the due date may incur late fees of up to but not limited to 15% of total of invoice

"Sharing with Regulatory Authorities: Because backflow prevention testing is a legally mandated public safety measure, Capitol Backflow, LLC is required to share your test results, assembly serial numbers, and property address with your local water purveyor or municipal water authority. We may also upload this data to city-approved third-party tracking portals (such as BSI Online) to satisfy your annual compliance reporting. By booking our services, you authorize this data transmission."
"Communication and Tracking: We use your contact information to send invoice details, text confirmations for technician arrival, and automated annual reminders. Because backflow tests are required annually by law, we will retain your assembly history to alert you 30 to 60 days prior to your next municipal deadline."
